Bondi Vet general terms of website use

1. Bondi Vet Global Pty Ltd (ACN 648 039 794) (Bondi Vet, us, we, our) operates a marketplace allowing retailers (Retailer) to advertise products and services to a person (Customer, you, your) via our platform at www.bondivet.com (Site) or any other platform we may introduce in the future (together, the Platform). We display Retailers’ products, allowing Customers to order products through the Platform or to link to a Retailer’s site to order products and services through the Retailer.

2. Where you purchase products and services through the Platform, you will need to agree to our Customer Terms of Use. Where you are just browsing or otherwise interacting with the Platform, including to link to a Retailer’s site, these terms and conditions (Terms of Use) will apply.

3. Your access to and use of the Platform and the data it contains is conditional on your acceptance and compliance with the terms, conditions, notices and disclaimers contained on this page and elsewhere on the Site or the App.

4. By using the Platform or the services, features or functionality offered through the Platform (Services) you agree to be bound by these Terms of Use.

SCOPE OF BONDI VET SERVICE

5. Bondi Vet acts as a marketplace to introduce Customers to a Retailer’s products and services. We partner with Retailers to display their products. We may receive payment or other compensation for featuring these Retailers on our Site.

6. Apart from enabling a Customer to identify potentially suitable products supplied by the Retailer, to the extent permitted by law, Bondi Vet accepts no liability for any aspect of the Customer and Retailer interaction, including the quality or description of goods and services offered by the Retailer.

ACCESS TO THE PLATFORM

7. You agree and acknowledge that use of the Services is at your sole risk.

8. You agree that you will not:

(a) use the Platform, Services or their content for any purpose that is illegal, beyond the scope of their intended use, or otherwise prohibited in these Terms of Use;

(b) compromise the security of the Platform;

(c) use or attempt to use another person’s Platform account without authorisation;

(d) use the Platform, Services or their content in a manner that violates the publicity, privacy or data-protection rights of others;

or

(e) use the Platform or its content for commercial purposes.

LIMITATION OF LIABILITY 9. To the extent permitted by law, we have no liability under any agreement formed between you and the Retailer. 10. To the extent permitted by law, Bondi Vet, Bondi Vet related entities, or any of their respective directors, officers, employees, contractors or agents make no representation or warranty:

(a) as to the accuracy, legality, suitability or reliability of the information contained in the Platform’s content;

(b) the quality or usability of the products advertised for any particular purpose; or

(c) that the Services will be uninterrupted, without delay, error-free or omission-free.

11. Except for liability in relation to breach of any implied condition, warranty or guarantee, including under the Competition and Consumer Act 2010 (Cth), the exclusion of which from a contract would contravene any statute or cause any part of these Terms of Use to be void (Non-excludable Condition), to the extent permitted by law, Bondi Vet specifically disclaims all liability for any loss or damage (actual, special, direct, indirect and consequential) arising out of or in any way connected with any transaction between Customer and Retailer.

NO WARRANTY

12. Except for liability in relation to any Non-excludable Condition, the Service is provided on an "as is" basis, and without any warranty or condition, express or implied. To the extent permitted by law, we and our suppliers specifically disclaim any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement to the extent allowed by law. PRIVACY

13. By accepting these Terms of Use you agree to the collection, use and sharing of information in accordance with the Bondi Vet Privacy Policy.

14. Further, you agree to comply with all applicable privacy and data protection laws in uploading any data to the Site and you warrant that all relevant consents have been obtained from any identifiable individuals.

INTELLECTUAL PROPERTY

15. You grant to Bondi Vet an unrestricted, worldwide, royalty-free licence to use, reproduce, modify and adapt any content and information posted on the Platform for the purpose of including that material and information on the Platform and as required to provide the Service, for the general promotion of the Service and as otherwise permitted by the Terms of Use.

VARIATION

16. If we make any variation to these Terms of Use, we will post them on our Site and notify you if the Terms of Use continue to apply to you at the time of the variation and the variation would be detrimental to you.

COMPLAINTS

17. If you have a complaint about the Service please contact us via our customer service tab

GENERAL

18. To the extent permitted by law, these Terms of Use are governed by the laws of Victoria, Australia. You and Bondi Vet submit to the exclusive jurisdiction of the courts of Victoria, Australia.

19. A failure by a party to exercise any right under these Terms of Use will not be considered a waiver of those rights.

20. The provisions of these Terms of Use are severable, and if any provision of these Terms of Use is held to be invalid or unenforceable, such provision may be removed and the remaining provisions will be enforceable.

21. These Terms of Use may be assigned or novated by Bondi Vet. If the assignment or novation is detrimental to you, you may terminate these Terms of Use.

22. These Terms of Use set out the entire understanding and agreement between you and Bondi Vet with respect to its subject matter.
